Terms & Conditions

Please take a moment to read and understand the Hotels terms and conditions for your booking

 

The Company enters into this Agreement as principal for Bookings made for the hotels it owns and as agent where a Booking is made for a hotel that it operates on behalf of the Hotel Owner. The booking confirmation will clearly state the identity of the Owner.

In these Terms and Conditions the following definitions apply:

1. Definitions

“Company” or “we” means Foundry 34  whose address is at 34 Burrowgate, Penrith CA11 7TA.

“Booking” means the booking for accommodation, functions and/or any other services or items made with us.

“Contract” means the Booking and these Terms, and any other terms and conditions stated to apply to the Booking.

“Hotel” means the premises for which your Booking is made.

“Terms” means these terms and conditions.

“Websites” means www.foundry-34.co.uk or any other website owned or operated by us relating to a Hotel from time to time.

“VAT” means value added tax.

Please note that by placing a booking you enter in to a legally binding contract with Foundry 34 (Penrith) Limited stating that you agree by the terms and conditions as set out below;

 

Cancellation / Booking Amendments Policy:
A Credit/Debit card is required to make a booking. For the purpose of card security a pre authorisation may be made on the card details given between 3 days before arrival and your arrival date. For booking made with us directly by our website or over the phone or via any other 3rd party source where full payment is not already made a Deposit of £1 will be charge at the time of booking. This is taken for 3D secure authentication. The full balance will be taken before 6am on your check in day unless specified otherwise in writing. If you have a change of plans and you wish to cancel your stay with us at Foundry 34 and you let us know by 2pm 3 days before you arrive you will not be charged and any deposit paid will be refunded. If you cancel within 3 days of your arrival date or in the event of a no show or you need to decrease the amount of nights you stay you will be charge the full cost of your stay from the card details provided. If you are booking 3 or more rooms together you will be required to pay a 25% deposit upon booking. If your plans change and you contact us before 2pm Seven days before your stay you will only be charge your deposit, if It is with in 3 days of arrival or in the event of a no show,  Full payment will be taken from your Credit/Debit card provided. If you have made your reservation via a booking agent such as booking.com / expedia you must contact them directly to make any cancellations or amendments, 

 

 

No Smoking Policy:
It is against the law to smoke with in the premises of Foundry 34. Any one found smoking in there room will be charged £250 plus any additional costs incurred by the hotel to put the room back in to order. 
For the benefit of smokers there is a smoking area outside on the roof terrace. 

 

Parking:
Foundry 34 does not have its own parking. There is an abundance of free on-street parking from 5pm to 9am Mon to Sat and all Day Sunday on the front of the hotel. For longer stays or parking 9am to 5pm Mon to Sat there is a low cost pay and display car park across the road. More info can be found on our website.

 

Pets:

The Hotel is a anti allergenic hotel, therefore we are unable to accept pets in to our guest rooms.

General Policy:

We reserve the right and you hereby authorise us to charge your credit or debit card for any damage incurred to your room or the Hotel during your stay (including without limitation specialist cleaning) or for any items that are missing when you leave. In the event of group bookings the paying guest and is responsible for all the other guests and in the event of damage or theft from rooms/facilities the party organiser or guest paying will be charged to the card details provided in full plus administration costs.

Damage, Breakages and Antisocial Behaviour – Respect, courtesy and dignity are the standards by which our patrons will be treated during their stay and we expect treatment of our property and staff in a similar manner.

Illegal Substances- Foundry 34 has a zero tolerance policy on all illegal substances (drugs). The police will be called any suspicion of illegal activity within our premises. Any guests found with illegal substances will be asked to leave immediately without refund. Any room left damaged by these substances inc smells will be charged for putting right.

Foundry 34 Hotel Provides a 24hr guest support service out of ours for emergency / urgent use. Charges may apply if this service is abused by the guest. I.e. frequent use for non emergency.

 

Guest Disturbance:

It is expected that all guests will respect the stay of others by keeping noise to a minimum. A duty manager is on call 24/7. If noise or behaviour is reported or found to be disturbing other guests the accused will be warned once only. If failure to comply after first warning the accused will be ejected from the premises without refund and blacklisted on the local and national database. 

 

Other information:

Breakfast is served between 7.00 am and 9.00 am Monday to Friday and 8.00 am to 10.00 am on Weekends/Bank Holidays. We have options for take-away breakfast packs for those making an even earlier start to the day.

Please note: Foundry 34 is a town centre located hotel as such on an rare occasion may leave you vulnerable to some noise pollution from traffic or from people outside especially if you choose to have the windows of the room open. On some Friday and Saturday evenings we have live music in the bar on the ground floor which finishes at 11:45pm*, this may also on some occasions cause some minor noise pollution in some rooms.  If this rare occurrence does pose you a problem, ear plugs can be provided to you free of charge from a member of staff. The family and the management work very hard to ensure every guest has an enjoyable visit and are open to feedback to ensure your stay is as enjoyable as possible.

Force Majeure

The Company accepts no liability and will not pay any compensation where the performance of its obligations is prevented or affected directly or indirectly by or as a result of force majeure or any circumstances beyond its reasonable control including, but not limited to, flood, earthquake, extreme adverse weather conditions, natural disasters, other acts of God, acts of terrorism, fire or failure of electric power, gas, water, or other utility service, plant machinery, computers, vehicles or any collapse of building structures.
